    Unhappy Please Help - I cannot get a consistent answer

    Hi,

    I have been to see a lawyer and spoken with UCSIS, but they have both given me different answers.

    First Question

    I am a greencard holder since 2005 and can apply for N400 in December 09.

    I have been offered a position by an American owned company to work overseas, but I want to preserve my status in the US.

    Should I apply for a N-470 permit? UCSIS says Re-entry, but I know that doesn't preserve your status.

    Second Question

    When we apply for N400 in December 09, we will be out of the country on an overseas work placement along with our N-470 permit.

    Do we have to physically return to the US to file the N-400 application?
    If so, how long do we have to be in the US before we can make the application?

    or

    Can we make the application from overseas and then fly back to the US for finger printing, interview and oath etc.

    Any help would be appreciated as I do not know what to believe.

    If you qualify for an N-470, you may file and then leave. You do not have to remain until it is adjudicated.

    Is this in answer to my question about the N470 or N400?

    Actually, it applies to both. You may file an N-400 from anywhere, though you need to file an N-470 while in the US. In both cases, you can file and then go abroad, if you wish.
