    Default Will be US Citizen soon, how to apply for son's immigration?

    Dear Ron,

    I will be taking the naturalization oath in June (of 2008). Here's my situation regarding my family's immigration.

    - As an LPR, I had applied for my wife's I-130 in 2004 and it was approved in April of 2005. I will upgrade her I-130 application after my naturalization.

    -- My son was born in June of last year (2007) in India and he too, just like my wife, has never been to the US. As I understand, I need to file a separate I-130 for him after my naturalization. Is my understanding correct?

    I will really appreciate if you could answer the following questions for me.

    -- How long does it usually take (I am in California) for USCIS to upgrade the I-130 status to Immediate Relative and inform the beneficiary for the counsular processing?

    -- Is I-130 route for my son the fastest way to get my wife and son in the US?

    -- Will my son get the US citizenship at the port of entry if he enters the country on an immigrant visa (an approved I-130 followed by counsular processing)?

    Your wife's petition will get upgraded automatically as soon as you naturalize. You don't have to file a new petition for her, just show the old approval notice and evidence of your naturalization. As for your son, he will need an I-130 petition filed on his behalf. Wait until you are naturalized to file or the CIS will put the petition in the backlog. When he enters as an LPR, he will get upgraded to US citizen.
