When To Terminate H1b Job After Filing H1-h4 Cos And Ead

    Hi all,

    Currently I am working with a H1b visa and have filed H4 COS and EAD in May. I put Aug 21 as the effective date for the H4. Do I have to terminate my current job before Aug 21 no matter my H4 EAD case is approved or not by Aug 21? Thanks a lot for any information.

    No. The effective date you gave in the application doesn't matter at all. The date when the COS gets approved is the real effective date of H-4 status. You can't start working until you have the physical card in hand for the EAD but you have to stop working on H-1B once your COS gets approved. So, there could be a gap between your employment because USCIS may take time to approve EAD after your COS approval and/or it may take additional time to receive the EAD card in mail.
