Visa Bulletin Changes Fall 2015

    Ideally one should expect a slight movement in September not sure why DoS thinks otherwise.

    Quick question to seniors - how come DOS / USCIS cannot be sued for not using 2015 quota up until summer for EB, they will have prove they utilized the visas by end of the fiscal year... isn't it breaking a law if one doesn't follow it??

    DOS definitely can do better..all it takes for them to use Excel/SP or other customized software's to identify the demand based on 140. You can always remove duplicates, etc. Also, I asked this question to Ron earlier, Can't they just predict the demand based on H4EAD applications? We all know they just don't want to do that. It is not Global Issue it is just backlogged countries issue as of now.

    While no one denies that govt operations are inefficient and there definitely exists room to put into place tools that improve and streamline processes, lets not be presumptuous to think that all it takes is an excel document and an afternoon to sort this out find out details. No one here has any idea of the type of data, the internal policies, the feeds, the systems and the constraints USCIS, Labor, State etc deal with. While this is an opportunity to improve and I agree to that but thinking "yeah why dont they just do X or Y and it solves the problem" is a long shot from being true. This is in no way supporting or endorsing their policies but just that they had spend billions on Elis and that was a failure. That was done by private consultants and top analysts from what I hear.

    I blame the USCIS entirely. They treat statistical information as if it were an atomic secret. They absolutely refuse to provide information to anyone, including other government agencies, concerning I-140 information.

    Ron, are you seeing RFE's for 2009 or 2010 EB2I filers as well, is there anything more to read in to and expect movement based on that?

    Don't read too much into that. About ten years ago, they issued RFEs every year when the medical results expired.

    Is there any Indian applying in Eb-3? Is there any one not porting from Eb3-I to EB2-I? Let Eb3-I enjoy for some time

    Maybe the 6 is inverted??

    Jokes apart, this makes me more skeptical of the VB movement once the new fiscal year sets in. If EB2I is now Jan 2006, where can we expect it to go with the new visas and spillovers? Earlier people were predicting mid 2009 and hoping for early 2010. Now I do not know.

    This is worrisome, at most even if they come back 2008, it will look like a Aggressive movement

    That's what I am afraid of.

    Another thing which I simply do not get is - why the Aug 2015 cutoff date for EB3WW??? That essentially means the category is current, but then why have a cutoff date? Is this to show that EB3I has not gotten any spillovers from EB3WW? EB3WW must be C in the next bulletin with the new visas. I will be really surprised if EB3WW has a cut off date like 15 Sep 2015 in the next VB.

    Also the question is why did EB2 China move from Dec 2013 to Jan 2006? This category has been moving along for a while in decent numbers. In a month, the retrogression is 7 years? how the hell does that happen?

    On the other hand, EB2C moved from 15 Dec 2013 to 1 Jan 2006. Talk about retrogression, wonder how they are taking it. This VB simply means that DOS scaled back to allow USCIS to finish processing and utilize most of this years quota. It is probably safe to say there will be minimal AOS applications this month.
