    All,

    With all the possibilities discussed so far, depending on what is announced today, essentially the difference to me looks like a choice for I140 beneficiaries between

    PD becomes current so AOS/EAD/AP happens with a clarification on "same or similar" classification + perhaps I140 cannot be revoked
    versus
    All of the above + a GC if Recapture is also done.

    For either of these the earliest, we can apply is 06/01/2015. Is that a fair assumption? I think just EAD for I140 via rule making cannot be done so quickly.

    The problem is how can "PD becomes current so AOS/EAD/AP happens with a clarification on "same or similar" classification + perhaps I140 cannot be revoked" without rulemaking which you yourself agreed here " I think just EAD for I140 via rule making cannot be done so quickly."

    DOS simply cannot make all EB categories current when the demand is higher than the quota. To do that, it has to be either reinterpretation and/or recapture.

    I feel if nothing gets announced in daily briefing of DOS @ 12:30 today .... then not much chance of anything coming out today

    Green card for 'myself' should not be the destination. The destination is fixing the system for good. It shouldcreate a better system where there is not such a long wait and also no employer takes advantage of immigrants.

    exactly. Under the current guidelines and rules USCIS cannot accept more applications when they know demand exceeds supply.

    Yes they can. If they decide to recapture visas, they will issue a revised VB for MAY. Think about it for a moment, the quota for this year would become 390,000 visas, minus the 60,000 or so that have already been used.

    In that case, I wonder why so many who have filed for AOS in 2007 are still waiting for a GC.
