Speculation On 140 Ead & Ap

    The administration certainly showed the intent. Unfortunately the DHS kneed the momentum by stalling the DOS on visa bulletin changes and sweeping the 140 EAD under the indefinite NPRM. The admin just stopped caring after DAPA got stuck. I am just happy that the H4 EAD got through before these anti forces got in the way.

    Clinton admin recaptured visas. Bush admin acted quickly to create a quota for Advanced Degree holders when visas exhausted in 2004 and then in 2007, it bullied DHS and USCIS into submission.

    I don't think this Admin believes we are suffering much, or see much political advantage in doing favors to us.

    Witness that a no-brainer like I140 portability is taking so long. It can't be because they're worried about giving a few 10s of thousands of people EAD. They were willing to give 5 MILLION EADs out a few months ago. It's just lack of any real interest.

    You got it right, it is the first one and that is because most of us make 6 figure salaries. From their perspective, we are not suffering much when compared to the undocumented.

    I have sympathy towards illegals as well, most of them are living very difficult life style compare to us at least we have hope that we will be green some day. There might be some culprits there as well but it's everywhere.

    It is unfortunate that's how they think of it. People spend 10-12 hours a day, every day of their life at work. Giving us portability would at least allow us to spend time doing what makes us happy.
    Also, ignoring the plights of legal immigrants is how they eventually become undocumented - it is unrealistic to expect someone to live status quo for a decade or more.

    I think being on the same job for ten plus years waiting is also suffering. You cannot visit your near dear ones at times of emergency if your visa is not stamped, constant fear in case the company you work has issues. cannot plan for things beyond 2-3 years. Remember we are high skill folks. Even then you are made to suffer.

    Agree with you. But I am one of those introverts, no twitter / FB - in today's world of social media I don't exist o_O.

    I am still hopeful of I-140 EAD rule, I know most of you have given up on that. Nearly all that was said in the EA was delivered - there were setbacks is another story...

    I did not have faith in Nov 21 2014 EO until Dec29 when USCIS published it in federal register. They followed it up with Q&A sessions until DACA got stuck in the courts.
