So even this is not happening until next year, sad state of procedures or lack of
The DoL is very deliberate with their regulations.
Switching a job is nightmare with GC in progress but atleast if they do this or give more flexibility on 140 EAD it would have made something easier, neither of the process seems to be anytime soon
Hi Ron / Others,
Do you think that slower perm processing times could lead to more spillover to EB2I / EB3I resulting in more visa numbers to those categories ?
No, I don't. They have more than enough cases in the pipeline to use up the entire quota a couple of times over.
True that, nightmare that is!!
My first PERM audit and subsequent denial took 2 years and 5 months. Can't beat that!!
What do you mean by "enough cases in the pipeline" ? Is it EB2ROW pipeline ?
EB2ROW is current. EB3ROW is almost current. If the rate of visa consumption in EB2ROW cat goes down due to perm taking longer, then it should free up more visas per quarter for the next backlogged category i.e. EB2I. Same goes with EB3ROW vs EB3I. At least that is what I was thinking (probably wishfully).
The USCIS has enough cases on file to exhaust the EB quota many times over. The State Department doesn't need to advance priority dates in order to get more applications on file.
Hi Ron ,
Is there any way out to check the status of the PERM by myself if I know the case number ?
No there isn't. Even if you had the employer's login credentials, all you would see is "in progress" until the case is approved.
Thanks Ron !
My first PERM was approved in 2 days.
you lucky dawg.. LOL
My husbands case is in the same camp! 2007 Perm went into audit for 2 yrs and by the time new perm was filed it was May 3,2010. Talk about luck! Would have had greencard by now on original perm... Fml missed the 2010 date Movement by few days...we are paying for our lawyer's mistake!
Anu - don't worry. You are not too far off. approx 2 years either way.
Mine is EB3. And 2 years 8 months PD I lost, is like dog years in EB3 terms.
Trying real hard for EB2 outside.
I am stumped. I sincerely hope and pray you can convert to EB2....
