Can I take paternity leave for one month as I'm blessed with baby in Dec'2014 i.e., without paycheck for period Jan'2015 while on H1B? My current H1B is valid till Oct'2015 and needs to file extension sometime in Aug/Sep'2015, will I face any problem during my extension approval. Pls advise.

    Thanks in advance!!

    Congratulations!

Yes you can. Just make sure that you and your employer document it in your personnel file. Write a letter or email requesting it and have your employer respond, granting it.

Thanks for your wishes Ron!! I have my parents in USA on visiting and I'm planning to extend their stay by applying for extension sometime in April'2015 which I need to attach some of my paystubs as part of documentation for income proof. If enclose Feb/Mar paystubs without Jan paystub is there chance for RFE?

Also, can you pls let me know the process and fee details for applying extension of stay for those who are in USA on B1/B2 visa.

    Have a great day!!

They need to file an I-539. They should include a letter from your wife's doctor and some proof of your ability to maintain them while they are here.

Yes. The principal applicant pays the fee and all dependents are included.

Thanks Ron for quick turnover!! Lastly, can you tell me how much fee is applicable and is there premium processing available for extension of stay for B1/B2 or only normal processing?

Please go to USCIS.gov, click on forms, and look for the information pertaining to form I-539,
