    The USCIS acknowledged that they are working on rules that will allow pre-registration filings, so that is real. As to why they are following both EAD tracks, I think that it is to encourage highly skilled workers to apply for immigrant status.

    While I am confident the H4 litigation is going nowhere, if there is litigation over pre-registration, there is a chance the plaintiffs could win. Think of this as belts and suspenders redundancy.

    Thank you, Ron. I know you have mentioned in multiple places that the USCIS is blatantly not following rules regarding issuance of EAD in a timely fashion. How come nobody brings a blanket lawsuit against them or is such a thing not possible?

    It is hard. First, you have to wait until they are beyond 90 days, then if you file an action, they get 60 days to respond. By then, they have issued the card and the action is moot.

    Ron, do you think outsourcing the administrative functions such as EAD issuance will free up their time to do the other things. Outsourcing is an option to their lack of urgency and incompetence..

    If only they would. Right now, the use contractors for their mailroom, lockbox facilities, biometrics, and call center help line. I've long advocated using private companies to do adjudications (under the supervision and review of USCIS personnel), but I just don't see it happening.

    infact EAD issuance and renewal can be completely automated.. I mean as long the candidate meets the certain requirements ... EAD is issued, its not a visa..
    Do you think they will seriously review all the emails and act on them.. ?

    I think they already know what they want to do and only asked for public comment so that they can say they did it.

    Ron, does that include visa revalidation? A simple fix like this (something which was already done before) can even make lives a lot better.

    Hi Ron, Have you heard anything new on EAD for I-140 approved people? This is one key thing in the executive action - seems to be taking lot longer than needed.

    There are fresh rumors every day. We do know that the USCIS has said that they are actively working on a rule to implement this.

    Its going to happen. Only not as fast as we had hoped. But not surprised considering USCIS is working on it and the government having other priorities in the EO.
