I am a member of the US army and a naturalized US citizen. We filed for my spouse I-130/ I-485 concurrently. He had entered the country in 2001 with C1 visa and overstayed. I was not aware that he was ineligible to adjust status in the US.
We received the denial for I-485 (I-130 approved).
Is there anything we can do at this point? Is there a waiver avilable to apply? We have a 18 months old US citizen daughter.

    Any information is appreciated.

Talk to your JAG officer about this and see if he or she can help you. If the JAG officer needs help, ask them to call me.
