LLC on EAD

    Hello,

    I have incorporated an LLC and am the sole owner of the company.

    I have an approved I-140 from 2010 and RD for I-485 of Dec 1, 2011. My company shut down its operations after I completed 180 days from RD.

    Now having started an LLC on EAD, do I need to pay myself a salary in order to generate paystubs in case there is an RFE from USCIS or I can go without salary for few months?

    You need to prove that you will be working in the same or similar occupational classification. That can be for yourself or for someone else.

    Hi Ron,

    Thanks for getting back to me. However, do I need to start paying myself a salary from Day 1 or I can wait until the dates become current once again.

    You have to be able to show that it is reasonable to believe that you will work in the same or similar occupational classification when your green card is approved. Salary between now and then is not really an issue.
