I-539 Question Related To I-140

    Hi Ron:

    In the I-140 application, eg for self-petitioned NIW, there is a question: "Part 7. Information on Spouse ... of the person for whom you are filing. List husband/wife ... related to the individual for whom the petition is being filed." However, even if we include the spouses name in the application, the 1-140 approval notice does not have the name of the spouse, only the primary applicant.

    Subsequently, when I-539 is being filed for the spouse: Q4: Has an immigrant petition EVER been filed for you or for any other person included in this application? Should the answer for the spouse be yes or no?

    That question asks if an I-140 has ever been filed on behalf of the applicant as the primary beneficiary of the I-140, not as a dependent.
