I-140 Approved Return To Old Employer Or File Aos With New Employer

    Hi Ron,

    I have 2 scenarios in mind ( Old employer I140 approved and not revoked):

    1. My I-140 is approved from previous employer and I plan to return to old employer in same department but with a promotion and different designation. Job duties still will be the same for immigration perspective, Can I still use my old I-140 and not go through the pain staking perm/i140 process again?.
    2. My I-140 is approved and I change employers, with the new EO will this still keep me eligible for AOS filing without new PERM/I140. New job is in same line as old job.
    Please let me know your thoughts.

    Right now, without any new regulations, no to both questions. That may change if they loosen up the requirements with the new executive action reforms.

    Thanks Ron, I believe the president has set a timeline of 120 days for deployment of this EO for Hi-Tech so next 3-4 months something should come out of it.

    I think next 4 to 6 weeks we will know all details with more clarity
