I-140 Approved, Changing Jobs

    Hello

    I am working as a tenure-track faculty member at a university (referred to as old university). I have approved I-140 through this old university.
    I want to move to a different university (referred to as new university) to work in the similar position. My question is: Can I file for EB-1B purely based on the job offer from this new university, without actually moving there until my EB-1B is approved? In the meantime as I await the result of EB-1B petition, can I continue working at this old university, that way I do not lose job or do not become out of status??

    Any input appreciated.

    As long as you have a new job offer in the future and you will join the new position in good faith, you should be fine

    Thanks DonDraper for a quick reply.
    So, if I follow these steps, I should be fine.

    1) I accept a job offer at a new university, file EB-1B.
    2) While EB-1B is being processed, I continue working at old university and not joint the new university
    3) The EB-1B is approved.
    4) I quit the old university and assume the position at new university.
