Hi Ron, Filing For Aos With Old Employer Evl - Timelines Accurate ?

    Hi Ron,

    Lets say - I have an approved I140 with PD Jan 2011 from Company A. The I140 is not revoked yet. I moved from A->B in 2012, and B->C in 2015.

    I believe, I485 can be filed now if the original job position exists with Company A, and company A will provide the letter (EVL). Company A is willing to take me when GC is approved, and I am willing to join Company A, though not immediately.

    Questions about timelines:
    If I file I485 now, I am assuming following will happen:

    - I will get EAD/AP in a few months in 2015.
    - The Jan 2011 PD will ensure that I485 will get approved in a few years , lets say 2018-2019.
    - I will be obligated to join Company A only in 2018-2019.

    Is the above timeline accurate ? When will I be mandatorily required to join Company A - is that only in 2018-2019 ? Until then can I use the EAD received in 2015 ?

    As long as you and company A act in good faith, you can do this.
