H4 I539 Rfe

    H1 expired Dec 12 2014
    Applied for H4 COS Nov 2014
    Stopped working by the H1 expiry date
    Now waiting for H4 approval.
    Got an RFE with this text -

    Evidence of Maintaining Status - I129 Beneficiary - H1B - XYZ (name of the person for whom i539 was submitted)
    USCIS Acknowledges receipt of copies may be copies of your pay statements. However the copies are illegible and unclear. USCIS requests that you submit the following:
    Evidence of the three most recent pay statements to establish and/or verify that XYZ has been maintaining valid non-immigrant status.

    I am assuming that they are requesting the H1b spouse's payslips.
    Should I send the h1b spouse's last 3 months payslip or should I send the last 3 payslips when I was on H1 (OCT-DEC 2014)?

    Your advice is highly appreciated!

    Sent RFE response last week. Still not updated in case status. the deadline is Sep 22. I am concerned that the status is not updated yet. Should I be?

    I have the fedex tracking number and it says delivered.
