H1b To F1 Change Of Status Application Rejected And Returned Along With Fee

    Hello,

    My cousin is working on H1B for two and half years(very small company with no immigration attorney) and his company said they many not renew his H1B so he thought about finishing his masters. On December 22 he applied for change of status with fee of $290 along with his I-20.

    On December 23, USCIS changed filing fee from 290 to 370

    His application was received on Dec 27

    He didnt receive a receipt notice but received rejection notice along with whole application (including the check) back stating that filing fee is incorrect and asked to file the application again.

    Now his company agreed to renew his H1B and he would like to continue the work and remain in H1B

    Does this rejection of application mean he is out of status or can he just ignore this and continue to work on H1B?

    Any inputs are appreciated.

    If his h1b has expired before filing cos than he is out of status

    His H1B and visa are valid until 8/31/2017

    The application was not accepted. It's like it was not filed.
