H1b Out Of Status Question Please Help?

    Hi all,

    I have been laid off from my full time job on Oct 21st. My employer said they would structure my severance such that I get bi weekly deposits till dec 16th (based on my service in the company). They said they would notify USCIS on my last day of payroll. I have filed for COS B2 on Dec 1st. am I okay ? Please advise

    Just an question my terminology may not be good. I only have one severence pay stub, the rest look like regular pay stubs.

    Hey, I am not a lawyer, but, as per my opinion, if your employer notifies to USCIS the date of layoff is Oct 21st, you will be treated out of status from that date, USCIS may or may not approve the COS. Better option was try to find a H-1B transfer ASAP on or before Oct 21st. Best of luck.
