H1 Extension On Approved I140 From Sister Company

    Hello,
    My wife works for a company A. She is on 6th year H1 right now (expiring end of this month). Her labor was filed for company A 3 years ago and it got denied. Then her labor/PERM was filed again for sister company B a year ago which got approved. Then they applied I140 based on approved labor which got approved too. My question is can she apply for "3 year H1B extension for company A" based on "approved I140 from sister company B". She is working for company A right now.

    Yes she can apply for H1B extension based on the approved I-140. She can do this for unlimited time and for unlimited companies, the only caveat is that the 140 needs to be active(not revoked).

    Yes, she is eligible to apply for her 3-year extension. The H-1B company and the I-140 company do not have to be the same to get the 3 year extension.
