Going Back To Old Employer - Old H1b Still Valid

    Hi Ron,

    I have an offer from my client to join them full-time. They generally don't sponsor h1 and don't have a strong immigration team. I was thinking if my petition with the client gets denied, can I go back to my old employer? The question is after my client files my H1 and I join them say for 2-3 months and after that if the denial comes, can I move back to my old employer without a new H1?

    Bad choice... Even if your old employer keeps your H1B, there will be red flag waiting for you. Ask your new employer to file PP. you pay for it if they don't agree. It's legal to pay PP fees, join the new employer only once your new H1B gets approved. Play safe.
