Employer Change, No Pay Checks

    Hi Ron..

    I am planning to change my employer since I am not being paid on time.
    The new employer will be sending all the required documents along with the copies of all the letters I sent to my current employer asking him to send my latest paychecks.


    Do you think USCIS will take any action on its own against my current employer(like contacting DOL), before approving my H1 ?

    File a formal complaint with the DOL and include a copy with your petition to the USCIS.

    I don't want to get DOL involved before I get the new H1 approved.
    Also, I want to be in a position to negotiate, all my back pay. Involving DOL means no more scope of negotiation, just wait for years till they complete their investigation.

    Then ask for consular notification and go home and get a new visa.
