Children On H4 Visa And Resident Fee In Universities

    Hi Ron,

    I hope that you are all well after surgery.

    My son on h4 visa is applying for university for Under grad . AS per University rules he has to pay international student fee . We are staying in same state since last 8 years. All my w2's are from the same state and My tax
    returns are from the same state. In between i heard some where in the forum that as per federal law , he is eligible for resident fee . Is it correct?

    if yes , can you suggest me how to send a request letter to university asking for resident fee.

    It all depends on the state. Some, such as California, allow H visa holders to establish residency for tuition purposes since the H category is dual intent. You have to look at the state tuition laws to determine your rights.
