Change Of Status From H4 To F1 For Canadian Student

    I am India born Canadian Citizen, in US on H4. My father, also a India born Canadian citizen is working in the US on a H1B. He has applied for a Green Card in EB2 category. Priority date is 2011. I am a student (Junior) at a US University. I am turning 21 in Aug and so have to change status (due to ageing out) before my father's GC is approved. As a Canadian Citizen, can I get F1 status by just going out of US & returning in a few weeks with the I-20 and SEVIS. Do I have to prove ties to Canada? I have passed out from a US public High School, so will I be allowed to continue paying resident fees in college?

    While you are not required to apply for an F-1 visa, you still have to comply with all F-1 requirements to gain F-1 status - including ties to your home country.
