Change Of Employer After 140 Approved. Retaining The Old Priority Date

    Ron,
    My new 140 approval didn't retain the old priority date. Both 140 approvals are on EB2 category. I was told at the time filing 485 , USCIS consider my old priority date when applying with my new employer. Please let me know if that is possible. Thanks in advance.

    You have nothing to worry about. Each I-140 approval notice is supposed to have its own priority date. 8 CFR 204.5(e) provides that you are entitled to the earliest priority date established by an I-140 filed on your behalf. When you file for adjustment of status, include a copy of the earliest I-140 approval notice, together with either a new I-140 or your most recently approved I-140 approval notice. You are entitled to the preference category established by your most recent I-140 approval, and the priority date established by your earliest approved I-140.
