Can I Transfer My H1 After I140 Is Withdrawn

    Hi,
    i am living beyond the 6 years h1 term, based on a approved i140.
    Recently i joined a new company and my i140 was withdrawn by my previous employer.
    My new company has refused to file my GC.
    I have around 1.5 years left on the current h1.
    Can i transfer my h1 to another company ?

    Unfortunately you can't do that... I wish I could have given you a positive answer. I see a solution and a hope though. Don't leave your current employer, that's your lifeline. Try to get an employer who can file your GC ASAP. Labor takes 3-6 months nowadays. Once that is approved, 140 approval can be filed on a premium basis. Your job is to get an employer who can file your GC without you joining them right now.Best of Luck.

    Once your I-140 has been withdrawn, you won't be eligible for another extension under AC 21.

    Do we know how to find out whether the I140 is still valid, other than talking to the previous employer

    I think you can look up the receipt number on USCIS case status and get the status
