    Hi Ron,

    I have EB3 140 approved.. Can I apply EAD and change employer and port to EB3 while on EAD? What would happen if current employer cancels my current 140.

    Thanks Ron for your inputs

    Things are moving pretty fast. But I doubt it will be a PR disaster if things slow down for Legals. Media doesn't care or have enough know how of legal immigration issues.

    Right now, as the law now stands, that would be fatal to your chances. The law might change, however.

    Ron, this was exactly what we discussed a couple of posts back. That would be really smart, but we will have to see how they manage it.

    Ok. Thanks. Do I have to make any changes if I need to do AOS or is it automatic? The reason I ask is If I have to initiate some changes from CP to AOS, I can start now rather than when the PD becomes current.

    Ron - your views on this please?

    No you don't have to do anything. If you designate CP on your I-140, and later change your mind, all you have to do is file for AOS and include a copy of the I-140 approval notice - just as you would if you had designated AOS. The problem is when you try to go the other way. If you designate AOS, and decide to switch to CP, it can take up to a year for the file to get transferred.

    that would be an excellent idea !! Wish you were working in USCIS :) definitely would have made things move a lot faster

    They have a problem with people who can count to eleven without taking off their shoes. Also, I don't speak their language. I never bothered to become fluent in stupid.

    As I have quit my company A and joined company B with approved I140 from company A .. I dont see I can get EAD soon as I have to go through PERM again

    mY wife has approved I140 from company A and she got offer from company B to be joined on Jan 2015

    Need your suggestion what should be done to get EAD

    Hi Ron,
    You may have replied earlier but I'm confused with the notes released by Fox news (from WH). It says that, DHS will make regulatory changes to allow these (LPR) workers to move or change jobs easily. What does LPR mean here, is it I140 or 485?
    Also it states that H4 holders can get EAD when primary has approved LPR application? When primary visa holder has an approved I140 they could apply for EADs for both primary & spouses. Why would we need H4 EAD, then?

    You have to have a valid PERM/I-140 in order to apply for AOS.

    That is very poorly worded. I think they mean AOS applicants.

    I have created a new discussion area with a number of sub-forums. It is devoted exclusively to discussions of the executive action on immigration. You can't see it yet. I will make it live as soon as we know the details of the different programs. Ideally, people will post their questions in those specific sub-forums so that it will be easier for visitors to search and post of particular interest to them.
