Action For People Interested In Becoming Plaintiffs In A Class Action To Recover Wasted Visas.

    This is for proposed litigation for recovery of visas wasted in previous years

    Guys, whoever are interested, can you start working on drafting your stories of the problems you've had because of being in the backlog? Some notes on what to write:

    1. No more than one page
    2. Try not to make it too emotional, at the same time, not too clinical.
    3. Focus on monetary losses, career issues, and family problems. Make sure to be specific about what problems you've had. i.e, missing out on job opportunities/promotions, family separation issues, that sort of thing.
    4. Don't focus too much on H1B/PERM issues, as these are separate. Put down your problems with them, but be sure to tie it into the backlog.

    Biggest takeaway after reading the letter should be how badly you've been screwed over by a very preventable backlog. That point should come across very well.

    Please start with how long you have lived in the country, a brief description of your job, how your legal status has affected your life, your efforts at getting a green card, your general contribution to the community etc. Please also provide your priority date, eb category, location.

    There is no doubt that visas were wasted. No one is denying that. That's why USCIS even asked the question directly in the RFI in Jan. The question is, do they have authority to recapture these wasted visas or are they simply gone? USCIS has refused to do anything about it. So, now we want to ask the courts to direct USCIS to recover the lost visas. The question is of course, do the courts have the authority to direct USCIS to do it? But we will not know unless we try, right?

    Correct...Do you know or anyone remember if there has been any litigation in past with visa recapture? I agree its worth trying if it has not been done until now.

    What's the status of this? Wasn't the plan to submit this to the litigation branch of AILA? Do we stand a good chance?

    We hope to do next week. The visagate litigation is sucking up all energy and time that we would have used on that front.

    not at the moment. We are into editing, and compiling everything at this point. We can't have too may people doing that. As they say too many cooks...

    We knew Visa recapture requires heavy lifting. visagate is a good learning experience for people like me who have not really been part of any litigations. Now we have a feel of what it takes to fight for recovery.

    visagate litigation is just a drop in the ocean. Recapture is going to be the real deal. Who knows which vested interests will put hurdles in which way.
