5 Year H1b Visa Validity And Restamping

    Hi Ron,

    I am about to complete 6 years on H1B. First one started in 2009 and ended in 2012; second cycle would end in 2015 Sep. All through this period, I have been working for the same company.

    When I went for visa stamping in 2012, they gave me a stamp that was valid until 2017. It also did not have the company name. I was initially worried about the correctness but i have never faced any problem due to this.

    I just received new I 797 which is valid from Oct 2015 - Sep 2018, again for the same company. I plan to travel to India again this year in Nov 2015.

    1. Do I need to get the stamping done now as I have a new I 797 or
    2. should I reuse the valid visa with new I797 until close to its expiry and get the stamping done later ?

    If you have an approved I-140, then you don't need to do anything.

    Thanks for your response Ron.

    I do have an approved I-140. Can you please elaborate a bit on how that dictates if new stamping is needed or not ?

    If you have an unexpired visa, then you don't need a new one, otherwise you do.
