Thread: Denied U S Citizenship.

    Unhappy Denied U S Citizenship.

    Can you help me Mr. Ron?

    I got married to a U S Citizen in 2001. In August 2005 she filed for divorce for adultry and court dissmissed it. Within 2 months from that she filed another divorced which court dissolved the marriage in January 2006.

    I got my permanent resident in 2002 and in 2007 I filed for N400. Unfortunately, it was denied due to adultry I commited.

    Do you know how long it will take me to re- apply for my citizenship?
    Is it going to count from the time of reported divorce 1 or 2?
    Do you know if it will start counting from May 2009 when the letter from USCIS stated my N400 was denied?

    You are eligible to apply five years from the last act of adultery.

    Ron,

    I want to update you about my case above.

    I called USCIS national center in Vermont and the gave me same reply to gave me above, " that I will be eligible to apply for N400 5 years from the last act of my extramarital affairs".

    I went to USCIS local office and they told my that I will be eligible to re-apply for N400 5 years from the date of my divorce.

    I am confused with 2 different information. What action do you think is necessary to find out the exact year to start counting for the 5 years?

    Both the GAO and the Ombudsman's office did studies and found that the people who give immigration advice on behalf of the CIS are wrong more often than they are right.

    You need to find an attorney in your local area - someone who can go to the interview with you.

    Att. Ron,

    Do I have to seek Attorney's help to fight this case? I want USCIS to say that I will be eligible to apply for N400 from the time I commited adultry and not when my ex-wife divorced me.

    Is this fight worth fighting?

    It depends on what they wrote in the denial. That is, the specific factual allegations and the legal basis cited. Please don't post it here. Talk to a lawyer about it.
