    Default Deportation to El Salvador

    Hello everyone... I have a quick question. My fiancee (not married).... got picked up 7 weeks ago and taken it, he has a "Final Deportation Order". He entered in 2005 and overstayed a 90 day visa. They are not pressing charges or anything but they are deporting him. I am moving to his country, we are at peace with this. However, we are not sure how long this may be. His brother from ES also got deported, and it took 6 weeks and 4 days.

    My fiancee has been in for 7 weeks now, currently in Pennsylvania at York County. We were both told several weeks ago it would be soon, last week I called and was told a week, then I called friday and was told they are still waiting on travel documents and then he'd be on a flight. And that's all he is waiting for.

    Does anybody have any experience with a time-frame for El Salvador, could it be this week or next? This is really making life hard, our family is just torn apart. We were expecting him to be fast like his brother and we just don't see why not, I don't get why they are still waiting on travel documents. He has no problems in his country, etc. I don't have his docs to supply them or anything so obviously we'd have to wait, but any idea on a time-frame?

    If he wishes to depart at his own expense, he can go almost immediately.

    No one has given him that option. I called and they said he had a "Final Deportation Order" and he will be deported. He is non-criminal, etc. I know of voulentary departure where you pay for your ticket but he didn't have that option.

    Apparantly he will be sent as soon as "Travel Documents are Reciveved from El Salvador".

    Can I still pay for his ticket and make it at his own expense? I'd gladly do that if it's possible. If it is do you handle cases like this and can you contact the necessary persons (for your fee of course)... I'd gladly pay lawyer fees if someone could help make this faster or pay his ticket... but no one has told us we have that option ...

    Please get back to me...

    It appears that the hang up is getting travel documents.

    Right which means there is nothing I can do lawyer or not, pay for flight or not. I got that part.

    So that leaves me with this, do you have any idea or have you had any experience with cases waiting on documents? How long is the normal or any average wait time? Just any number you've seen would be useful. They were requested June 4, 2009. the ice agents tell me "they could come any day now, they fedex them so once they're processed they get here fast". But they been telling me that for a week + now.

    Isn't it true that the maximum hold time if the person has no criminal problems (which he doesnt in neither the USA or ES)...90 days from when the final order of deportation is issued? His order was issued way before, so that would put us at 55 days.

    Or is that not true?

    Do you have any idea what we might be waiting time wise...

    If your fiance has been ordered removed, they may hold him as long as necessary to get the travel documents he needs.

    It's already been 2 months!

    There is nothing I can do to speed up this process (And no, I don't have his passport).

    legally I mean. Nothing? He has no rights? Is there anyway this can be sped up with or without a lawyer, or is it literally just wait now?

    Do you know how long it may be?

    I don't know what to tell you. He entered the United States without the documentation that is required by international law for travel. He has been detained here as someone not in legal status. They aren't going to release him under those circumstances and they can't remove him until they get travel documents from his home country.

    He entered legally with a passport (which is still valid) and a visa for 90 days but he overstayed it.

    I just don't have his passport. But he entered with valid documentation.

    Sorry, my mistake. He needs his passport, however, to leave. If he doesn't have it, then he needs to wait for a replacement. The government cannot remove him without valid documents.
