    Default Would to be employer's lawyer asking for all I485 supporting documents

    Hi Ron,

    I have an approved I140 and a pending I485. I got a conditional offer pending immigration checks, from a company. As part of this, I submitted all I140 material, the Labor Certificate and I140 approval notice, so that they can match labor cert job responsibilities with the current one.

    Now they are asking for all I485 supporting documents. These would be Tax Returns, all immigration history, past pay stubs etc.

    Is it legal on their part to ask all this ?

    I worked on EAD before. The previous employer just checked my I140 application since it was pending then and they wanted to make sure that it is approvable. But this Company is really asking a lot more. Please advise.

    They can ask for anything they want, but you are under no legal obligation to give them anything related to your AOS processing beyond your receipt notice and your EAD card. Also, if the EMPLOYER's lawyer is asking for this, I'd be concerned about a conflict of interest. Tell the lawyer that you won't even consider giving them such documents unless and until they assure you in writing that they accept all liability, known and unknown, for anything adverse to you that might result from such disclosre. Of course, they will refuse. When they do, ask them why and tell them that if they are unwilling to assume responsibility, you aren't willing to make disclosure.

    If they withdraw their employment offer, you might want to consult an employment attorney about suing them.
