  • Bahamas Cruise - Use AP as re-entry?

    Dear Ron,

    I'm planning to go on a 3 Nights Cruise to Bahamas (from Florida) with my family.

    My current status is H1B and my wife who is my dependent is working using her EAD - We had filed for our 485 in January this year and have our Advance Parole with us.

    (a) The H1B and H4 visas on our Passport expired more than 2 years ago.
    (b) Our current EAD/AP combo card is good till 3/2/2013 and we have already applied for its extn

    Based on the information above do you think I need to worry about my current status and will there be any problem while my re-entry into the USA? Are the CBP officers knowledgeable enough to handle AP applicants?

    Yes, carry your advance parole documents and passports. You shouldn't have any issues when you return.

      Do I have to surrender the i94 that I currently have before leaving and will I be issued a new one upon entry?

        I doubt they will take it from you when you leave. It's OK either way.
