    Hello Ron,

    I have the following questions about Form I-765:

    1) Question #11 : Have you ever before applied for employment authorization from USCIS?

    Given that I was on OPT for a year after my F1 , should I mention "Yes", specify the details and include a copy of my OPT
    card?

    2) Question #16 is about eligibility categories from a list mentioned in the I-765 instructions. I have been on H1-B since 2003. I could not find a category for H1-B in the I-765 instructions. What is the appropriate code for my case?

    Your assumption with respect to your first question is correct. As for the second, you don't need an EAD if you hold H1B status, nor are you eligible. This is for limited categories, such as student OPT and AOS applicants.

      My current status is H1-B and my priroity date is current as of the Feb visa bulletin. Hence, I am applying for AOS. I plan on filing I-765 along with it. Given this information, what option from the list of specifications mentioned in the I-765 instructions document should I select as an answer to Question #16? I could not find the appropriate information for my case.

        In that case, the only prior employment authorization requested would have been the OPT.

          Thank you for the reply!

          Question #16 on I-765 asks, "Go to Part 2 of Instructions, Eligibility Categories. In the space below, place the letter and number of the category you selected from the instructions".

          When I go through the I-765 instructions, I cannot find any category that applies to me. Any suggestions as to what I should look for?

            It depends on your specific situation. Presumably you are an applicant for adjustment of status?

                Check the box that says that you are an AOS applicant.
