  • What does all this mean?

Loosely translated, please let me know what this means.

M sister received this letter in the mail

The above petition has been approved. the petition indicates that the person for who you are petitioning is in the United States and will apply for adjustment of status. The information submitted with the petition shows that the person for whom you are petitioning is not eligible to file an adjustment of status application at this time.

Additional information about eligibility for adjusment of status may be obtained from the local USCIS office serving the area where the person for whom you are petitioning lives.

Until the person for whom you are petitioning files an adjustment of status application, or applies for an immigrant visa, this approval petition will be stored in this office. If the person for whom you are petitioning becomes eligible to adjust status based on this petition, he or she should submit a copy of this notice with Form I-485, Application for Permanent Residence. Form I-485, Application for Permanent Residence. Form I-485 may be obtained at the local USCIS office

If the person for whom you are petitioning decides to apply for an immigrant visa outside of the United Stated based on this petition, the petitioner should file a form I-824, Application for action on an Approved Application or Petition, with this office to request that we send the petition to the Department of State National Visa Center (NVC)

The NVC processes all approved immigrant visa petition that require consular action. The NVC also determines which consular post is the appropriate consulate to complete visa processing. It will then forward the approved petition to that consulate.

The approval of this visa petition doe snot in itself grant any immigrant status and does not guarantee that the alien beneficiary will subsequently be found eligible for a visa, for admission to the United States, or for an extension, change, or adjustment or status.

What does this mean, what should be he next step in the filing process, is there a next step?

let me know if you have any questions.

    Thanks

It means that the petition has been approved, but the beneficiary is not eligible to apply for adjustment of status. It could be that they wrote that because the beneficiary's priority date is not current, or it could be that there is something in the beneficiary's record that makes him or her ineligible to adjust. In either case, the file has been sent to the NVC for further processing.

thank you Ron, in the meantime, does she just wait? is there anything that she needs to do?

Additionally, how do you get your priority date to become current, is that left up to teh NVC or is there something that she needs to do?

      Thanks again!

Re: What does all this mean?

She should just sit back and wait. She can check the Visa Bulletin every month (http://travel.state.gov/visa/bulleti...etin_1360.html) to see if her priority date is current. The NVC will notify her when her priority date is close to being current. There is nothing that she can do to make her priority date become current, other than wait.
