I am filing for my mother's greencard.In I-130 form it asks to give all the names used(includes maiden).My question is in the section C-7(under other names), should i leave this blank or should i give my mother's name with her maiden name included.I am thinking that if i am doing that then i may have to provide more documentation( which i don't have).for eg for her date/place of birth i am using non availability plus 2 affidavits from relatives.I also have her pan card.her non availability was issued with her new name.My parent's marriage certificate was made almost 25 yrs after their marriage and has my mother's new last name in it.Also keep in mind that all of her paperwork is with my mother's new name.<br />
if i mention her maiden name will i be asked for more paperwork?<br />
Please help.</div>

I have several petitions in Immigration but my children have not yet been able to benefit from any of them.<br />
My brother filed for me in Sept 2000 and they were my dependents.This has been current for sometime but we are unable to make use of it as I  acquired my green card based on an employment category since 2007.<br />
My  priority date  for the employment category is June 2006 ROW.My children were also dependents on this case but because they had to coulselor process they have yet to benefit.<br />
 <br />
In July 2010 I went ahead and filed I-130 for them as there is only small movement with the employment category, plus it s movement is far too erratic.<br />
 <br />
My concern  is with my daughter who will be 21 in May 2011.I notice that  the California office is very behind with their processing dates.<br />
What if the priority date becomes current and there is no decision yet?<br />
What if nothing happens before she reaches 21 will she age out? <br />
Will she be able to retain any of the priority dates from the previous petitions?</div>

I am a US citizen and applying for GC for my mom. We just received the letter for my mom's I-485 interview. I have a question that needs your help. Here is my mom's situation:<br />
<br />
4/26/10: entered US the 2nd time after returning home county for (~40 days). Was only given 3-month stay until 7/25, with "no AOS/COS/EOS" annotation on her I-94.<br />
<br />
7/13/10: filed I-130 and I-485 concurrently for my mom.<br />
<br />
8/19/10: I-485 fingerprint for my mom<br />
<br />
9/1/10: received letter for I-485 interview for end of October<br />
<br />
Will my mom be asked questions about her annotation on I-94? If they asked whether my mom was intending to immigrate at her entry to US in April, how should we answer?<br />
<br />
note: My mom's marriage certificate and criminal history was done during her stay at home country (shortly before her entry 4/26/10). But her birth certificate was done after her entry (4/26/10).<br />

This morning I read somewhere that if you were denied Entry at POE and were given Form I-877 and or I-831 ( sworn statement in administrative proceedings) you are banned to enter US for 5 to 10 years. is this true at all? I am really worried about my F4 Visa now. I was denied entry to US in 2009 Jan at Vancouver,Canada POE and given a form I-877/I-831. I have visited US under the same b1/b2 visitor visa earlier and styed in US for 3 days and came back to canada.Also in my visitor  visa application in Vancouver US embassy I have truthfully answered that My sister applied for my F4 immigrant petition. The CBP officer cancelled my B1/B2 visa and told me that I can only go to  US if I ever granted an immigration VISA. My PD ic approaching soon.Also when I become Canadian Citizen next year would this denial have an effect in entering US with Canadian passport. Please help me clarify these. I really appreciate it. I came to USA on J-1 visa, and after my contract with the company I worked for ended, I moved to another city where I met my husband. A few months after we got married,he applied for I-130 and got an approval notice, but we haven't been able to apply for AOS until now. However, because my visa has expired I'm not really sure what to write in the forms, so here are my questions:<br />

I-485<br />
1. Current USCIS status? My visa expired in November 2008 , should I write J-1 or Applying for adjustment of status or out of status or something else?<br />
2.Expires on -Are they asking about I-94 expiration date? If so, should I write D/S since that is what the officer wrote on my I-94? (The only other document that I have is DS-2019 which says "Form covers period from:06/02/2008 to:09/30/2008, should I also send a copy of this form?)<br />

1. Manner of last entry - Should I write J-1 student or J-1 exchange visitor? (I was a student in my country when I got the visa, but I was in USA on work and travel program)<br />

I'm LPR/GC. My overseas wife's I-130 was approved last April and sent to NVC.<br />
I recently got from NVC two visa fee bill invoices ($404 each) for her and our first child that was listed on petition at time of filing in 2007. In the mean time our second baby was born in October of 2009, unfortunately petition was not then updated with USCIS in this regard. How do i go on updating NVC now, or do i have to file new I-130 with uscis (or DoS?) for a second child? Am i too late?<br />
 <br />
Also am i required to obtain separate immigration visas for our children (they are about to turn 5 and 1 years old) or they can be simply listed on my wife's visa in order to bring them? And do i submit separate affidavits of support for all three paying separate $70?<br />

In july of 2010 i tried to get my tourist visa in  the matamoros consulate, but the consul did not gave me the visa, and also keep my son's passport, after 2 hrs, she return an told me that the passport was canceld and and the citizenship of my son will be canceld, just bacause i am from mexico, and attend a midwife in south texas. What can i do tu get the passport back?? Is it true that they can canceld the citizenship of my son???<br />
