    Hi Ron,

    I know that you have post replies to a similar question before; however, I want to ask for your help.

    I have came to USA as a visitor and decided to stay and study here. Once graduated, I have work for a university and switched my F1 to H1-B. Right now I m in the process of finishing my PERM toward the GC.

    I m originally from work, and I have not seen my family and friends since 2000. I want to know how difficult will it be get my Visa stamp in Morocco so I can return to my work. I want to play it safe at the same time I so miss my family :-(

    You have a couple of choices. You can go home and apply for an H1B visa to return, or you can wait until you are able to file for adjustment of status and get advance parole. With AP, you don't need a visa to return.

    Since I m going through an EB3 it will take some time to do so. I would love to go there and get visa. At the time, I will be nervous as it will be a possibility that they might not grant me one. Have you had similar clients from Morocco with a similar case?

    It depends more on your unique facts than the specific visa post. If you have a solid case for a new visa, you will get it.

    I can of do. However, I was more concern with the background check. Do you know how long those can take?

    How long is a piece of string? It can take as long as it takes. Some get wrapped up in a day or two, others take weeks or months.
