Thread: EB2 to EB1B?

    Default EB2 to EB1B?

    My University had filed my EB2 (India) in August'07 (concurrent I485/I140). By the look of things, it could be another year or more before there is action on that application (my PERM was done in May 07).

    My University has also agreed to do my EB1-B application simultaneously. Is it OK to have a separate EB1 application in process? Can I use the I485 filed with EB2 for EB1, once the EB1 I-140 is approved? How long is it generally taking for EB1B-I140 to process?

    Yes it is. The CIS will allow you to insert your new I-140 into your existing file. When it is approved, you will then be eligible to have your adjustment granted.

    Very hard to say. They always take a long time on EB1 cases. count on about a year.

    KipSkip: Me and another 3 friends have applied for EB1s and all of them have been approved in a year or a couple months more than a year after sending the application. included the change of status (i-485).

    I am preparing supporting evidence as follows. Could you please advise if this is sufficient or if I should explore additional paperwork. I am an Assistant Professor.

    1. 6 letters of reference (US, Canada, China, Europe)
    2. Complete CV (have more than 60 publications). Do I need to include copy of all citations?
    3. Citation list (not a copy of citation papers). I have a more than 600 citations to my papers from Google Scholar. I am just printing out the screen shot of Google scholar. Do I need copies of some papers that cite my work?
    4. I have won various awards, including best paper.
    5. I currently serve on editorial board, program committees, etc.

    It is difficult, if not impossible, to provide a "one size fits all" list of evidence. Look at the different types of evidence specified in the regulations and try to present as much CREDIBLE evidence as possible in as many of those areas as you can.

    Ron,
    My EB 2 application is pending. I am planning to apply for EB1B. I am an Assistant Professor. For me to apply for EB1B, do I have to be on H1B? Can someone with a pending 485 (who is on EAD) apply for another I-140? Also, my priority date Nov, 2005. Do you have opinion about whether I may have any chance of receiving green card this year?

    You may file another I-140 as long as you are qualified. Your nonimmigrant status has nothing to do with this.

    BTW, while the CIS will not accept premium processing filings for NIW cases, they will for outstanding researchers.
